If you have your own instance you have access to user comment and post history (even if deleted), voting history, IP address, and more for every other instance you’re federated with.

And why are you making the assumption that an instance is being seized by law enforcement? They almost certainly have their own instances just for data collection.
The only way Lemmy works is by sharing all of that data with all of the other federated instances. With your own instance you can choose whether or not to ingest all of that data.
And the point is that you wouldn’t know whether an instance is owned by the feds. There doesn’t even have to be any activity on the instance. Literally anyone can do this at any time and no one would know.
